Terms of service	Terms and Conditions Participation Agreement Welcome to the FugitiveHunters.Com Terms and Conditions Participation Agreement. This Participation Agreement is for Subscribing Member or "User", Data Posting Agencies or "Provider” and Private Members with authorized use of this Website and Database. You will find that the contents of this standardized document serve to protect the interests of all members and participants of the FugitiveHunters.com website and database. This agreement is designed to make use of the FugitiveHunters.com website and database more comfortable for you, your business, your customers, law enforcement communities, and everyone using or viewing the FugitiveHunters.com website and database particularly with regard to privacy. FugitiveHunters.com takes great measures to ensure the information you transmit is treated with respect and great care. There are three parts to this Participation Agreement. Part 1 focuses on the Conditions, Responsibilities and Terms of the Subscribing Member and Users to the "Provider" FugitiveHunters.com, and Conditions, Responsibilities and Terms of Provider to Subscribing Members and Users in regards to their legal agreement and Contract. Part 2 focuses on the Conditions, Responsibilities and Terms of the Posting Agency and Bail Agency to the "Provider", FugitiveHunters.com, and the Conditions, Responsibilities and Terms of Provider to all Posting Agencies and Bail Agencies in regards to their Legal Agreement and Contract. Part 3 of this Agreement is information that relates to All Users, Subscribing Members, Posting Agencies, Bail Agencies, Law Enforcement Agency or any other person or agency uploading information or images to FugitiveHunters.com. By clicking the "I Agree" button of this page and Proceeding further you are confirming Agreement of these Terms and Conditions and entering into a Legal Agreement and Binding Contract with FugitiveHunters.com or Provider. Please review the following Terms and Conditions Agreement carefully, then, if you wish to proceed, simply click the "I Agree" button to begin. Thank You and Welcome to FugitiveHunters.com. PART-1 USERS AND SUBSCRIBING MEMBERS Scope of Agreement Subscribing Members or "Users" desire to purchase a service from the Provider for the purpose of accessing Providers Website and viewing information stored on Provider's Database. Provider operates and maintains a database of wanted fugitive information accessible only by subscribing public and private members or "Users" and the posting agencies for the sole purpose of establishing an online database of fugitives, fugitive information, and the rewards, if any, provided and maintained solely by the Participant pursuant to this agreement. Participant is solely responsible for maintaining the information their agency or organization posts to the Provider’s database. Provider is not responsible for the Information which is posted on this site or its accuracy. Information gathered and/or viewed on this site by User is to be verified by the User by other means than the Provider. Subscribing users and all participants have entered into legal and binding contract with Provider by agreeing to the terms and conditions of Provider and FugitiveHunters.com by checking the agreement box on this page of the FugitiveHunters.com website. Such terms and conditions are utilized in the Terms and Conditions Participation agreement provided before subscribing to Provider’s service. Said contract with User is made in order to obtain financial payment and to restrict website and database access to the user which purchased providers service to ensure User has gained legal permission to use FugitiveHunters.com and enter into any legal agreements with Provider. Subject to the terms of this Agreement and in consideration of the mutual covenants stated below, User and Provider agree as follows: I. Definitions 1.1. "Authorized Officials" means any and all FugitiveHunters.com personnel, participating bail bonds agency employees, authorized law Enforcement Agencies, and any other duly authorized persons or organizations granted access by FugitiveHunters.com to utilize Provider's website. 1.2. "Data" includes, but is not limited to, the name, address, birth date, phone number, last known addresses, addresses of relatives or family relations of fugitive (18 years of age or above), mug shot in digital picture format, places they frequent, type of vehicle driven, description of vehicle, place of employment (current or previous), personal habits, past history of violence or drug use/drug dealing, and any assumptions, opinions or relative information that provider deems necessary to contribute within the privacy laws of the city, county, state or the United States of America. 1.3. "Law Enforcement Agency" means any municipal, county, state or federal government staffed and operated agency whose primary purpose is law enforcement, and/or criminal investigation, as contemplated by the GLBA (15 U.S.C. § 6801, et seq., and 15 U.S.C. § 6821, et seq.) 1.4. "Provider" means the organization, also known as FugitiveHunters or FugitiveHunters.Com that provides a database driven website that consists of persons wanted for a crime, or crimes that was provided by the Participant. Provider is only responsible for the maintenance and upkeep of the website and database only. Provider, under no circumstance, can be held liable for information posted on FugitiveHunters.com. 1.5. “User” or "Subscribing Member" is an Individual who has Purchased Access to Provider's database and has subscribed to membership of FugitiveHunters.com website and Database and has agreed to the Terms and Conditions Participant Agreement provided therein. Also any Individual who has viewing access to unsecured pages of FugitiveHunters.com Website and/or Database. II. Responsibilities of Subscribing Member/User 2.1. The utilization of data accessed on this website is the sole responsibility of the Subscribing Member or User alone. FugitiveHunters.com or "Provider" has only established a database where Subscribing Member/User can access fugitives, fugitive rewards, and any related information deemed necessary to locate and the said Fugitive. The Provider, FugitiveHunters.com in no way suggests Anyone attempt to contact any person, wanted by law or otherwise, with the intention of apprehending or detaining them. Any information about any person posted on Provider's website should be forwarded to the proper authority via Posting Agency offering Reward. Subscribing Members/User agrees to follow all laws governing Fugitive Recovery, Bail Enforcement, Private Investigations, Law Enforcement or any other laws in regard to individual location inquiry in the United States and the individual State which Subscribing Member/User utilizes information gathered within Provider's Website. Subscribing Member/User will follow all instructions and procedures established and furnished by Provider for Proper Website, and Database Usage. 2.2. Subscribing Member/User agrees to make exceptional efforts to insure that all Data is within Providers Website is not transferred, sold, rented, given, loaned, or accessed to or by anyone other than the authorized person or persons having access to Provider’s Website and Database. The responsibility of said information lies solely upon the Subscribing Member/User to treat all information in accordance to laws governing personal information within the United States, the state which the information is accessed or transferred, and city and county laws where the Subscribing Member/User is traveling. Additionally, Subscribing Member/User will, in good faith, make efforts to contact Posting Agency with any information the Subscribing Member/User feels needs correction, or warrants changing for any reason. 2.3. Participant will utilize its own computer and maintain its own standard Internet connection to upload data to Provider's website. FugitiveHunters.com is not responsible for providing any additional software needed for non-standard or outdated computers which does not meet minimum requirements necessary to utilize Providers service. III. Responsibilities of Provider 3.1. Provider agrees to operate and maintain a database for the purpose of providing Subscribing Member/User with opportunity, by method of financial agreement, to access the information and images uploaded by Bail and Law Enforcement Agencies regarding wanted Fugitives. Provider also agrees to provide reasonable instructions and procedures on Providers website for the procedures of viewing Data and Images. 3.2. Provider agrees that only Licensed Bail Agencies and Law Enforcement that have entered into legal contract with provider will have access and ability to post information and images on Provider’s Website. Providers Administration technicians, Support Technicians, and Special Privilege Users will also have complete or limited access to uploaded data, images and/or Participant information for maintenance, financial, support, legal and statistical purposes. Any Subscribing Member/User entering into legal contract with Provider will have complete access to the Data uploaded by the Posting Agencies with exception of the Posting Agencies private information given to Provider. Subscribing Member/User is responsible for following any Privacy Laws within local, state, or Federal jurisdictions. IV. Conditions of Subscription or Usage of Provider's Website 4.1. Provider reserves the rights, at its sole discretion, to change, modify, add or delete any portion of this Agreement, in whole or in part, at any time, if required by local, state or federal law, rule or regulation without prior notice to Subscribing Member/User. A notice will be sent to Subscribing Member/User if such an instant occurs within 30 days. Subscribing Member/User may terminate agreement and/or contract with Provider in writing and will terminate at the end of Subscribing Member/User’s payment term upon such notice. 4.2. Provider may monitor Subscribing Member/User’s access to Provider's website, but Provider agrees to use and only disclose Data received from Subscribing Member/User, or collected through Subscribing Member/User’s use of Provider's website, for the sole purpose described in Section 3.2 above. 4.3. Because Provider does not verify Data being provided by Participant, Provider cannot and does not represent or endorse the accuracy or reliability of Data or information displayed or distributed through Provider's website. Submission of Data by Posting Agencies and any reliance by any Law Enforcement Agency, Bail Bonds Agency or Subscribing Member/User, upon any Data or other information displayed or distributed through Provider's website is at the Law Enforcement Agencies', Bail Bonds agencies, Subscribing Members and Participant's sole risk. Upon notice by Participant and/or Law Enforcement, or without any such notice, Provider reserves the right, in its sole discretion, to correct any errors or omissions in Data contained in any portion of Provider's website. 4.4. Provider reserves the right at all times to disclose any information as necessary to satisfy any local, state, or federal law, regulation, or to edit, refuse to post or to remove any Data, in whole or in part, that in Provider's sole discretion is in violation of any local, state or federal law. Provider also reserves the right at all times to remove any and all data or images Provider deems inappropriate 4.5. By uploading Data or engaging in any other form of communication utilizing Provider's website, Subscribing Member/User hereby grants to Provider a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty free license to use, copy, distribute, display, reproduce, transmit, modify, edit and otherwise use such Data in accordance with and to the extent allowed by the terms of this Agreement. Subscribing Member/User hereby waives all rights to any claim against Provider for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, ownership rights and rights of attribution in connection with such Data. 4.6. Subscribing Member/User acknowledges that by subscribing to, and/or utilizing Provider's website, no confidential, fiduciary, agency, joint venture, contractually implied or other relationship is created between Subscribing Member/User and Provider other than pursuant to this Agreement. 4.7. Subscribing Member/User understands and agrees that by entering into this Agreement, Provider has not and does not represent that Subscribing Member/User participation or involvement in the Provider's website in any way limits or restricts a Law Enforcement Agency, or subscribing User from utilizing other means to procure Data or other information from Participant. V. Term 5.1. This Agreement will become effective as of the date acknowledged and remain in effect until the term following cancellation or termination by Subscribing Member/User or Participant as described below. 5.2. Either Subscribing Member/User or Provider may terminate this Agreement by providing a 30-day written notice. 5.3. Provider may immediately and without notice, terminate this Agreement for cause, at Provider's sole option, if Subscribing Member/User: (a) fails to perform in accordance with its responsibilities contained in Section II of this Agreement; (b) fails to perform any other obligation required of Subscribing Member/User under this Agreement; or (c) violates any local, state or federal laws, rules or regulations. 5.4. Subscribing Member/User may immediately and without notice, terminate this Agreement, at Subscribing Member/User sole option, if Provider: (a) fails to perform in accordance with its responsibilities to Provider contained in Section III of this Agreement; (b) fails to perform any other obligation required of Provider under this Agreement; or (c) violates any local, state or federal laws, rules or regulations. PART-2 BAIL AGENCIES AND OTHER DATA POSTING PARTICIPANTS Participation Agreement for Data Posting Agencies Scope of Agreement Participant #1 owns and operates one or more bail bonds agencies that provide a service to clients by securing bail by surety bond, property bond, or by cash bond which ensures client appears before a court of law within a specific amount of time set by that court of law. Participant #2 is a member of a local, state or federal law enforcement agency that may utilize FugitiveHunters.com for the purpose of posting a wanted fugitive from their city, county, or state, or other, for the purpose of providing a reward to the general public or private investigations agencies, or bail enforcement agencies. Provider operates and maintains a database of wanted fugitive information accessible only by subscribing public and/or private users for the sole purpose of establishing an online database of fugitives, fugitive information, and the rewards, if any, provided and maintained by the participants. Participant or posting agency is solely responsible for maintaining the information their agency or organization posts to the Provider’s database. Participant desires to submit Data to Provider's database, and Provider desires to maintain database containing the data from Participant pursuant to this Agreement. Subscribing users and all participants have entered into legal and binding contract with Provider by agreeing to these terms by the agreement box on the "Become a Member" or "Post a Fugitive" pages of the FugitiveHunters.com website, or any links that lead to these. Such term is utilized in the End User or Subscriber’s or "Members" agreement as well as the "Participant" agreement provided before subscribing to Provider’s service. Said contract with Provider is made in order to obtain information of the participants legal standing in the United States of America, specifically the state which participant conducts business, in connection with the license of participants bail agency or law enforcement agency to ensure participant has legal reason to use FugitiveHunters.com and enter into any legal agreements with Provider. Subject to the terms of this Agreement and in consideration of the mutual covenants stated below, Participant and Provider agree as follows: I. Definitions 1.1. "Authorized Officials" means any and all personnel of participating bail bonds agency or law Enforcement Agency duly authorized to utilize Provider's website. 1.2. "Data" includes, but is not limited to, the name, address, birth date, phone number, last known addresses, addresses of relatives or family relations, above 18 years of age, of fugitive, mug shot in digital picture form, places they frequent, type of vehicle driven, description of vehicle, place of employment (current or previous), personal habits, past history of violence or drug use or dealing, and any assumptions or relative information that provider deems necessary to contribute within the privacy laws of the city, county, state or the United States of America. 1.3. "Law Enforcement Agency" means any municipal, county, state or federal government staffed and operated agency whose primary purpose is law enforcement, and/or criminal investigation, as contemplated by the GLBA (15 U.S.C. § 6801, et seq., and 15 U.S.C. § 6821, et seq.) 1.4. "Provider" means the organization, also known as FugitiveHunters or FugitiveHunters.Com that provides a database driven website that consists of persons wanted for a crime, or crimes that was provided by the Participant. Provider is only responsible for the maintenance and upkeep of the website and database only. 1.5. “Participant” is a law enforcement agency or Bail Bonds Agency licenses with the state and county which it conducts business, that posts certain individuals wanted for a crime or crimes to Provider’s website for the purposes of offering rewards for information that leads to their capture. II. Responsibilities of Participant 2.1. The data copied to this website is the sole responsibility of the participant alone. FugitiveHunters.com or "Provider" has only established a working database to where Participant can post fugitives, fugitive rewards, and any related information Participant deems necessary to locate and arrest the said Fugitive. Participant agrees to upload its Data to Provider's website on a daily basis, or as required by the agreement between Participant and Provider. Participant will follow reasonable instructions and procedures established and furnished by Provider for uploading Data. 2.2. Participant agrees to make exceptional efforts to insure that all uploaded Data is complete and accurate since the responsibility of the Data is entirely upon the Participant. Additionally Participant will correct information which Participant receives that is in contradiction to any information already posted to Providers website: FugitiveHunters.com. 2.3. Participant will utilize its own computer and maintain its own standard Internet connection to upload data to Provider's website. FugitiveHunters.com is not responsible for providing any additional software needed for non-standard or outdated computers which does not meet minimum requirements necessary to utilize Providers service. III. Responsibilities of Provider 3.1. Provider agrees to operate and maintain a database for the purpose of receiving Data from Participant. Provider also agrees to provide reasonable instructions and procedures on Providers website for the input of Data and Images by Participant. 3.2. Provider agrees that only End Users or "Members" that subscribe to providers service will have access to Data submitted by Participant, for the sole purpose of identifying persons as wanted fugitives suspected of committing crimes against the laws of city, county, state, or the United States of America. Providers Administration technicians, Support Technicians, and Special Privilege Users will also have complete or limited access to uploaded data and/or Participant information for maintenance, financial, support, legal and statistical purposes. Anyone subscribing to provider’s services will have complete access to the Data uploaded by Participant with exception of Participant's information regarding its agency. Participant is responsible for following any Privacy Laws within local, state, or Federal jurisdictions. IV. Conditions for Participation in Provider's Website 4.1. Provider reserves the rights, at its sole discretion, to change, modify, add or delete any portion of this Agreement, in whole or in part, at any time, if required by local, state or federal law, rule or regulation without prior notice to Participant. A notice will be sent to Participant if such an instant occurs within 30 days. Participant may terminate agreement and/or contract with Provider in writing immediately upon such notice. 4.2. Provider may monitor Participant's downloads to Provider's website, but Provider agrees to use and only disclose Data received from Participant, or collected through Participant's use of Provider's website, for the sole purpose described in Section 3.2 above. 4.3. Because Provider does not verify Data being provided by Participant, Provider cannot and does not represent or endorse the accuracy or reliability of Data or information displayed or distributed through Provider's website. Submission of Data by Participant and any reliance by any Law Enforcement Agency or Bail Bonds Agency upon any Data or other information displayed or distributed through Provider's website is at the Law Enforcement Agencies', Bail Bonds agencies, Subscribing Members and Participant's sole risk. Upon notice by Participant and/or Law Enforcement, or without any such notice, Provider reserves the right, in its sole discretion, to correct any errors or omissions in Data contained in any portion of Provider's website. 4.4. Provider reserves the right at all times to disclose any information as necessary to satisfy any local, state, or federal law, regulation, or to edit, refuse to post or to remove any Data, in whole or in part, that in Provider's sole discretion is in violation of any local, state or federal law. Provider also reserves the right at all times to remove any and all data or images Provider deems inappropriate 4.5. Participant understands and agrees that by entering into this Agreement, Provider has not and does not represent that Participant's participation or involvement in the Provider's website in any way limits or restricts a Law Enforcement Agency, or subscribing User from utilizing other means to procure Data or other information from Participant. V. Term 5.1. This Agreement will become effective as of the date acknowledged and remain in effect until the term following cancellation or termination by Provider or Participant as described below. 5.2. Either Participant or Provider may terminate this Agreement by providing a 30-day written notice. 5.3. Provider may immediately and without notice, terminate this Agreement for cause, at Provider's sole option, if Participant: (a) fails to perform in accordance with its responsibilities contained in Section II of this Agreement; (b) fails to perform any other obligation required of Participant under this Agreement; or (c) violates any local, state or federal laws, rules or regulations. 5.4. Participant may immediately and without notice, terminate this Agreement, at Participant's sole option, if Provider: (a) fails to perform in accordance with its responsibilities to Provider contained in Section III of this Agreement; (b) fails to perform any other obligation required of Provider under this Agreement; or (c) violates any local, state or federal laws, rules or regulations. PART 3 INFORMATION REGARDING ALL PARTIES OF AGREEMENT VI. Disclaimer of Warranties and Limitation of Liability PROVIDER SPECIFICALLY DISCLAIMS ALL REPRESENTATIONS, CONDITIONS, AND WARRANTIES, WHETHER EXPRESSED OR IMPLIED, ARISING BY STATUTE, OPERATION OF LAW, USAGE OF TRADE, COURSE OF DEALING, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, SATISFACTORY QUALITY, RELIABILITY, OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO PROVIDER'S WEBSITE AND PROVIDER'S SERVICES TO BE ACCESSED, USED OR DELIVERED PURSUANT TO THIS AGREEMENT. PROVIDER'S WEBSITE, INCLUDING ALL DATA, CONTENT, SOFTWARE, FUNCTIONS, MATERIALS AND INFORMATION MADE AVAILABLE ON OR ACCESSED THROUGH PROVIDER'S WEBSITE IS PROVIDED "AS IS" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. PROVIDER DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN PROVIDER'S WEBSITE OR ANY DATA, MATERIALS OR CONTENT CONTAINED THEREIN WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PROVIDER'S WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE IS FREE OF VIRUSES OR OTHER DEFECTS VII. Miscellaneous 7.1. Assignment. Provider may assign or delegate all or part of Provider's rights or duties under this Agreement after a (30) day notice to Participant or Subscribing Member. 7.2. Severability. If any provision of this Agreement is held to be unenforceable, in whole or in part, such holding will not affect the validity of the other provisions of this Agreement, unless Provider deems the unenforceable provision to be essential to this Agreement, in which case Provider may terminate this Agreement, effective immediately upon notice to Participant or Subscribing Member. 7.3. Force Majuro. Neither Provider or Participant will be liable for any failure or delay in performing an obligation under this Agreement that is due to causes beyond its reasonable control, such as natural catastrophes, governmental acts or omissions, laws or regulations, labor strikes or difficulties, transportation stoppages or slow-downs. 7.4. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the United States, and the State of Texas, without regard to conflicts of laws provisions. Sole and exclusive jurisdiction for any action or proceeding arising out of or related to this Agreement shall be in an appropriate state or federal court located in the State of Texas, or the State of which Participant's Business, Businesses or Residence is located, or that of which Subscribing Member Resides, or wherever said infraction of law occurs, whichever applies by law. 7.5. Entire Agreement. This Agreement constitutes the entire agreement between the parties, and shall supersede all prior agreements and understandings, if any, between the parties respecting the subject matter hereof.
